The Work Health and Safety Act 2011 (the Act) applies at residential premises when:
· a contractor is engaged to carry out work there
· the resident employs a person to perform work there
· the resident works there as part of a business or undertaking.
While work is being carried out in these circumstances, a person conducting a business or undertaking (PCBU) has a duty of care under the Act.
Managing work health and safety
Work Health and Safety Act 2011 (WHS Act) and Legislation states that a person conducting a business or undertaking (PCBU) at a workplace must ensure that the business is conducted without risk to a person's health and safety.
All workers are protected by the WHS Act. This includes employees, contractors, subcontractors, apprentices and trainees who perform work. The WHS Act also provides protection for the general public so that their health and safety is not placed at risk by work activities.
The WHS Act places the primary health and safety duty on a person conducting a business or undertaking (PCBU), who must ensure, so far as is reasonably practicable, the health and safety of workers at the workplace.
So who or what is a (PCBU?)
Person conducting a business or undertaking (PCBU) is a person conducting a business or undertaking alone or with others, whether or not for profit or gain. A PCBU can be a sole trader, a partnership, company, unincorporated association or government department of public authority.
What is due diligence?
Due diligence in relation to ensuring health and safety is defined for the first time in the WHS Act 2011. In demonstrating due diligence, officers and persons with a duty will need to show that they have taken reasonable steps to:
· acquire and update their knowledge of health and safety matters
· understand the operations being carried out by the person conducting the business or undertaking in which they are employed, and the hazards and risks associated with the operations
· ensure that the person conducting the business or undertaking has, and uses, appropriate resources and processes to eliminate or minimise health and safety risks arising from work being done
· ensure that the person conducting the business or undertaking has appropriate processes in place to receive and respond promptly to information regarding incidents, hazards and risks
· ensure that the person conducting the business or undertaking has, and uses, processes for complying with duties or obligations under the WHS Act 2011.
